Dentist's failure to properly secure dentures; failure to timely remove denture resulting in infection - $2,600,000.00

Plaintiff, a then 65 year old man presented to his dentist for a new set of dentures. After the dentures were put in place, the plaintiff returned complaining that they were loose. The dentist testified that he could not perform anymore work on the dentures directed the plaintiff to go directly to the laboratory that created the dentures. When the plaintiff arrived at the laboratory, they refused to speak with him advising him to go back to his dentist. Several days later the plaintiff swallowed his denture while drinking water. He went to a hospital where a gastroenterologist attempted to remove the denture. The attempt was unsuccessful ultimately resulting in a perforated esophagus and ensuing infection in the brain.



Failure to communicate results of an abnormal mammogram - $1,700,000.00

Plaintiff, a then 35 year old woman underwent a mammogram at her local ob/gyn clinic. Following the exam, she returned to obtain the results of the study. She was told that the physician was not available on that day and that she would contact her if there were any problems. Our client did not hear from anyone at that clinic and presumed that the results were normal. Approximately two years later she developed hip pain which was ultimately diagnosed as breast cancer which had spread to her bones. She died approximately three years after her diagnosis.

Failure to recommend a colonoscopy and failure to advise the plaintiff of liver metastasis - $1,240,000.00

Plaintiff, a 54 year old woman who despite her age was never referred for a screening colonoscopy by her family doctor. In she underwent a hernia repair. While at the hospital, she underwent radiological studies which revealed liver abnormality. The plaintiff, however, was discharged from the hospital without being informed of the liver abnormality. Subsequently she was diagnosed with colon cancer with metastatic disease to her liver. The abnormality seen on radiological films while she was in the hospital for hernia repair was in fact the metastatic disease . The plaintiff ultimately passed away as a result of colon cancer and the metastatic disease to he liver. The case was brought against her family doctor and the hospital. The case against the hospital for their failure to advise her of the liver abnormality was settled for $400,000.00. The case against the family doctor for falling to send a woman over the age of 50 for a screening colonoscopy was settled for $840,000.00.



Failure to recommend a colonoscopy resulting in a delay of diagnosis of colon cancer - $1,050,000.00

Plaintiff, a 49 year old man presented to his primary care physician complaining of weakness. A blood test performed revealed anemia. Despite these symptoms, the physician failed to recommend that the plaintiff undergo a colonoscopy to determine the location of a possible gastrointestinal bleed. Approximately five months thereafter, the plaintiff underwent a colonoscopy and was diagnosed with stage III colon cancer. The plaintiff underwent a colon resection and chemotherapy.



Failure to properly interpret a mamogram - $1,000,000.00

Plaintiff, a 54 year old woman with a history of a breast mass underwent a mamogram which was read as normal. Thereafter, the plaintiff was diagnosed with Stage III breast cancer and underwent a mastectomy and chemotherapy treatment. It was alleged that the mamogram was misread resulting in the delay in diagnosis of the breast cancer.



Failure to properly treat a brain injury resulting in death - $1,000,000.00

Plaintiff, a 35 year old male presented to the hospital and was diagnosed bleeding in the brain following a street assault. Because of the bleeding he required intubation to preserve and assist with breathing. It was alleged that the plaintiff died as a result of botched up intubation and not as a result of the brain bleed.



Failure to timely recognize a bile leak after gall bladder surgery - $950,000.00

Plaintiff, a then 69 year old man presented to a gastrointestinal surgeon with complaints of abdominal pain. He was diagnosed with gall stones and recommended to undergo gall bladder surgery. Following surgery, plaintiff's blood work showed an elevated bilirubin. Despite the abnormal lab study the patient was discharged from the hospital. Two days later, the patient was admitted to a hospital and diagnosed with a bile leak, jaundice and sepsis requiring surgery to repair the leak.



Failure to timely Diagnose and Treat Gastric Cancer - $800,000.00

Plaintiff, a then 62 year old woman presented to her primary care physician with complaints of difficulty swallowing. Her doctor referred her to a gastroenterologist who performed an upper gastrointestinal series and diagnosed the patient with a hernia. Approximately one year later, the patient was admitted to a hospital with flank pain where she was diagnosed with Stage IV gastric cancer. She passed away approximately sixteen months following her diagnosis.

Failure to properly treat a urinary tract infection resulting in sepsis and aortic valve infection - $825,000.00

Plaintiff, a 51 year old male presented to a urologist to undergo a urological procedure. Following the procedure, the plaintiff developed a urinary tract infection which was treated with an improper course of antibiotics. Approximately, seven months later, the plaintiff was admitted to the hospital where he was diagnosed with aortic valve infection requiring open heart surgery.



Failure to timely diagnose and treat lung cancer - $750,000.00

Plaintiff, a then 59 year old man with a past medical history of coronary artery disease and myocardial infarction complained of shortness of breath to physicians in his cardiac clinic and to his primary care doctor. The complaints were attributed to his cardiac etiology. Approximately seven months later the plaintiff was diagnosed with lung cancer and died three months after diagnosis.



Failure to refer for a cardiac catheterization - $700.000.00

Plaintiff, a then 54 year old male presented to his primary care physician with complaints of dizziness and shortness of breath. The plaintiff was examined and told to go to the hospital the next day for a cardiac catheterization. The following morning, the plaintiff was found unconscious on the street and transported to the hospital. The plaintiff died before arriving to the hospital. It was alleged that the physician should have referred the plaintiff to the hospital on an emergent basis instead of recommending to wait for next day for a cardiac catheterization.



Failure to maneuver a patient following gastric surgery resulting in decubitus ulcers and death - $675,000.00

Plaintiff, a then 56 year old woman presented to the hospital for gastric surgery. It was alleged that the physicians and hospital staff failed to maneuver the patient at indicated intervals resulting in the development of decubitus ulcers leading to an infection and death.



Failure to properly interpret a mamogram resulting in a delay in diagnosis of breast cancer - $650,000.00

A 58 year old woman underwent a routine mamogram which she was told was normal. Approximately 18 months later, when she underwent a repeat mamogram it revealed an abnormality which was ultimately diagnosed as Stage II cancer . She underwent a mastectomy and chemotherapy treatment and is currently cancer free. The claim against the radiologist is that the mamogram was not properly and carefully read and interpreted. This resulted in the delay of diagnosis of cancer at a later stage with a worsening of the prognosis.



Failure to diagnose gastric cancer - $500,000.00

Plaintiff, a then 27 year old woman presented to a gastroenterologist with complaints of epigastric pain. The gastroenterologist examined the patient and prescribed Zantac. It was alleged that plaintiff's complaints did not resolve and she returned to the gastroenterologist several months later where no other form of treatment was performed. The gastroenterologist denied that such visit ever took place. Approximately nine months following the initial complaints, the plaintiff was diagnosed with gastric cancer with metastasis to her ovary. She died approximately one year after her diagnosis.

Failure to diagnose an infection following gastric bypass surgery - $500,000.00

Plaintiff, a 53 year old woman underwent gastric bypass surgery. She was discharged from the hospital but returned approximately one week later complaining of abdominal pain. She was examined and discharged without antibiotics despite signs of an infection. She again returned to the hospital approximately one week later and diagnosed with an abscess requiring several surgeries.



Failure of the landowner to remove lead from the apartment - $500,000.00

Three children claimed to have ingested lead resulting in behavioral issues with one of the children.



Failure to properly interpret a mamogram - $450,000.00

Plaintiff, a then 64 year old female underwent a mamogram which was read as normal and advised to return in six months. Approximately six months later, the plaintiff underwent another mamogram which was read correctly and lead to a diagnosis of breast cancer. The claim was that the improperly misread mamogram resulted din the delay of diagnosis of breast cancer at a later stage.



Failure to properly interpret a mamogram - $450,000.00

Plaintiff, a 56 year old woman underwent a routine mamogram which was read as normal. Approximately one year later, the plaintiff underwent a repeat mamogram which revealed Stage II breast cancer. It was alleged that the radiologist misread the mamogram films resulting in a delay of diagnosis of breast cancer.



Failure to properly position the arm during hernia repair surgery - $425,000.00

Plaintiff, a 56 year old male presented to the hospital for a hernia repair. It was alleged that during surgery, his arm was not properly positioned resulting in nerve damage.



Administered improper dosage of insulin resulting in death - $400,000.00

Plaintiff, a 80 year old male with a history of Parkinson’s disease, diabetes, dementia and myocardial infarction presented to a hospital with decreased level of responsiveness. While at the hospital, it was alleged that the plaintiff was administered an excessive dose of insulin resulting in diabetic coma and death.



Failure to properly perform a cholecystectomy resulting in a bile duct injury - $400,000.00

Plaintiff a 40 year old male presented to a surgeon with complaints of abdominal pain. The surgeon recommended and performed a laparoscopic removal of the gallbladder. During surgery, the surgeon cut the wrong part of the gallbladder anatomy which required two revision surgeries.



Failure to timely diagnose malignant melanoma - $397,727.27

Plaintiff, a then 55 year old female presented to the hospital complaining of a spot on her leg. She was informed to place ointment and return for follow up. Approximately four months later, the patient presented to a different doctor who performed a biopsy and diagnosed malignant melanoma.



Failure to properly interpret a mamogram - $350,000.00

Plaintiff, a then 74 year old female underwent a routine mamogram and was informed that there were no abnormalities. Approximately six months thereafter, she presented to a different medical institution that also performed a mamogram which was read as normal. As instructed, the plaintiff returned one year later for another mamogram which was read correctly and revealed breast cancer. Plaintiff passed away unrelated to the breast cancer.



Failure to properly secure safety netting during construction resulting in a trip and fall - $349,500.00

Plaintiff, a 72 year old male tripped and fell over safety netting when entering his building. As a result of the fall, the plaintiff sustained a hip fracture requiring two surgeries.



Failure to properly treat bowel obstruction - $325,000.00

Plaintiff, a then 74 year old female presented to the hospital with abdominal pain. The plaintiff was examined by a gastroenterologist and a surgeon. Despite a high probability of an intestinal obstruction, surgery was not performed. Several hours later, the plaintiff suffered a cardiac arrest and passed away.



Improper maintenance of an elevator resulting in a fall - $325,000.00

Plaintiff, a then 74 year old female tripped and fell when exiting the elevator of her building. As a result of her fall, she sustained a fractured hip, fractured wrist and fractured shoulder.



Failure to timely recognize decreased blood flow following vascular surgery - $300,000.00

Plaintiff, a then 63 year old male was diagnosed with an abdominal aortic aneurysm for which he underwent surgery. Several hours after the surgery, it was alleged that a first-year resident failed to properly check the plaintiff’s pulse in his lower extremities resulting in a delay in diagnosing vascular flow insufficiency. As a result, plaintiff required further surgery and lost some mobility in his leg.



Failure to properly monitor elderly resident of a nursing home - $275,000.00

Plaintiff, a then 83 year old woman suffering from dementia and liver cancer fell in a nursing home resulting in a hip fracture which necessitated surgery.



Mis-read of CT-Scan resulting in unnecessary surgery - $250,000.00

Plaintiff, a then 35 year old male presented to a hospital with complaints of chest pain. A chest CT-Scan was performed and the plaintiff was diagnosed with an aortic dissection. The plaintiff was transferred to a different medical institution on an emergent basis where he underwent surgery to repair the aortic dissection. Intra-operatively, it was discovered that the plaintiff did not suffer an aortic dissection.



Failure to recommend a colonoscopy to a plaintiff who was over the age of fifty - $225,000.00

Plaintiff, a then 63 year old male was under the care of a primary care physician for several years. Despite his age, he was not referred for a screening colonoscopy. The plaintiff was ultimately diagnosed with colon cancer before the cancer spread to the lymph nodes or any other organs. The plaintiff ultimately underwent a colon resection.



Infection following a cardiac catheterization - $210,000.00

Plaintiff, a 60 year old male with a history of diabetes underwent a cardiac catheterization. Following the catheterization, the plaintiff developed an infection requiring surgery.



Improper supervision resulting in suicide - $200,000.00

Plaintiff, a then 86 year old male with a history of mental illness was left unattended overnight by a home attendant. He was found dead the next morning from suicide.
